The process and condition to establish a financial leasing company outside (inside) of free trade area

1、外资融资租赁公司在自贸区内设立融资租赁公司，注册资本不超过3亿美金的审批权限在自贸区管委会。The foreign financial leasing company establishes a financial leasing company, if the registered capital is no more than thirty hundred million, the approval limits of financial is in the administrative committee of free trade area

2、在区外注册的融资租赁企业审批权限在上海市商务委。The approval limits of financial of leasing enterprise which is registered in outside of the area is in commerce commission  

3、外资融资租赁公司外方投资者净资产要大于500万美元。The property of foreign investor of the foreign financial leasing company should beyond five million.

4、外资融资租赁公司Zui低注册资本不低于1000万美元。The lowest registered capital of foreign financial leasing company should not less than one million.

5、中外合资融资租赁公司外方出资比例不低于25%。The proportion of foreign investment in Sino joint venture financial leasing company is no less than 25 percent.

6、新设公司的经营期限不大于30年。The operation period of new established company is no more than thirty years.

7、新设公司2名高管从事租赁行业经验不少于3年的证明。To issue the certification that there are two senior executives’ leasing industry experience in new established company is no less than 3 years

8、内资融资租赁公司设立的Zui低注册资本为人民币1.7亿元人民币。

Whether the company is inside free trade area can do the business with the exception of free trade business, and what are the specific operations?

在自贸区中的融资租赁公司可以从事以下业务模式：The financial and leasing company in free trade area can work on the following business mode:

1、在境外购买租赁物租给境外承租商to buy the lease holds in foreign countries and rent it to overseas operators

2、在境外购买租赁物租给境内承租商to buy the lease holds in foreign countries and rent it to domestic operators

3、在境内购买租赁物租给境外承租商to buy the lease holds in china and rent it to overseas operators

4、在境内购买租赁物租给境内承租商to buy the lease holds in china and rent it to domestic operators

以上模式除第4个之外，其他只能在自贸区中注册的融资租赁企业才能操作。
